Terms of Service for OpenEFT

1. Acceptance of Terms

By accessing or using OpenEFT (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

2. Description of Service

OpenEFT is a fingerprint card conversion service that:

  • Converts FD-258 fingerprint cards to EFT (Electronic Fingerprint Transmission) format
  • Generates files compatible with ATF Form 1/4 submissions
  • Processes digital fingerprint images and converts them to standard formats
  • Provides one-time access to conversion features after purchase

2.1 Independent Service Disclaimer

Important: This is an independent hosted service for convenience. The underlying tool is provided as-is. OpenEFT.org is not officially affiliated with the original OpenEFT project or any government agencies. While we strive for accuracy, you are responsible for verifying all converted files before submission to any official body.

3. Purchase & Payment

One-Time Purchase, One-Time Conversion

  • OpenEFT conversion access is a one-time purchase for one conversion only
  • Each purchase allows you to convert ONE fingerprint card to EFT format
  • After purchase, you receive a 24-hour access link via email
  • Once you confirm and upload your conversion, your purchase is marked as USED and cannot be reused
  • If you need to convert additional fingerprint cards, you must purchase again
  • Payments are securely processed through Paddle, a third-party payment processor
  • All fees are exclusive of applicable taxes (e.g., VAT, sales tax)

File Retention Period

  • Converted files are stored in secure cloud storage for 7 days from the time of conversion
  • You will receive a download link via email valid for 7 days
  • After 7 days, all files are automatically and permanently deleted
  • It is your responsibility to download and save your files within this period
  • We cannot recover files after deletion

4. Refund Policy

Refund Eligibility

Refunds are available under the following conditions:

  • You request a refund within 14 days of purchase
  • You have NOT confirmed and uploaded your conversion (no EFT files were generated and stored)
  • You experienced a technical issue that prevented you from using the service

No Refunds After Conversion

Important: Once you complete the review page and confirm your conversion upload, your purchase is marked as USED and NO REFUNDS will be issued. You are given a clear review step before final confirmation to ensure accuracy.

How to Request a Refund

To request a refund, contact Paddle at https://paddle.net/, the click on look up my purchase and input the email that was used during the transaction. EU and UK residents also have additional consumer rights outlined in Section 10.

Refunds Not Available

  • Refunds are not available if you have already confirmed and uploaded your conversion
  • Refunds are not available after 14 days from the date of purchase
  • Refunds are not available if your files were automatically deleted after 7 days (this is clearly communicated)

5. Access & Usage

  • After purchase, you will receive a magic access link via email
  • The access link is valid for 24 hours from the time of purchase
  • You can request a new access link if your original link expires, as long as you haven't used your conversion
  • One purchase = one conversion only. Once you confirm and upload your conversion, you cannot submit another one
  • You are responsible for keeping your access link confidential
  • Access links are non-transferable and may only be used by the purchaser
  • OpenEFT reserves the right to deny access to users engaging in fraudulent or abusive behavior

6. User Accounts & Responsibilities

  • You are responsible for providing accurate email information for receiving your access link
  • You agree to use the Service only for lawful purposes
  • You must not upload content containing illegal material or content that violates others' rights
  • You are responsible for verifying the accuracy of converted files before submission
  • You comply with all applicable laws regarding fingerprint submission and data handling

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Upload or transmit viruses, malware, or malicious code
  • Attempt to gain unauthorized access to the Service or its systems
  • Reverse engineer, decompile, or extract source code or algorithms
  • Infringe on intellectual property or privacy rights of others
  • Impose excessive load on our infrastructure
  • Reproduce, distribute, or publicly display converted files without authorization

8. Content & Intellectual Property

Your Content

  • You retain ownership of all fingerprint images and documents you upload
  • You grant OpenEFT a limited license to process and convert your content solely to provide the Service
  • You represent that you have all necessary rights to upload and process the content
  • File Retention: Converted files are stored for 7 days, then automatically deleted
  • Temporary processing files (uploaded fingerprint images) are deleted immediately after conversion
  • We do not retain your biometric data longer than necessary to complete the conversion

Our Content

  • All software, algorithms, interfaces, documentation, and trademarks are the exclusive property of OpenEFT
  • You may not copy, modify, distribute, or create derivative works without prior written consent

9. Limitations of Service

  • Conversion accuracy depends on image quality and clarity of fingerprints
  • You must manually review all converted files before submission
  • Processing times may vary based on server load
  • OpenEFT is not responsible for errors in source images or fingerprint data
  • The Service is provided "AS IS" without warranties of any kind

10. Consumer Right to Cancel (EU & UK Residents)

If you are a consumer in the European Union or United Kingdom, you have the right to cancel your purchase within 14 calendar days, with certain exceptions. To exercise this right, contact us with your order number. If you have already received and used the service (converted files successfully), your right to cancel may not apply. Paddle is our payment processor and may provide additional consumer protections. See Paddle's terms at paddle.com.

11. Privacy

Your use of the Service is governed by our Privacy Policy. We do not sell your personal information and only share it as described in the Privacy Policy or required by law. We implement security measures to protect your data during processing.

12. Third-Party Services

The Service uses the following third-party services:

  • Paddle - Payment processing and billing
  • Resend - Email delivery for access links
  • AWS/Cloudflare R2 - File storage and CDN

Your use of these services is subject to their respective terms and privacy policies.

13. Termination

OpenEFT may suspend or terminate your access immediately if you:

  • Violate these Terms
  • Engage in illegal or abusive behavior
  • Attempt unauthorized access to the system

14. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "AS IS" without warranties
  • We are not liable for indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid for your purchase
  • We are not responsible for lost data, business interruption, or conversion errors

15. Indemnification

You agree to defend, indemnify, and hold harmless OpenEFT and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your uploaded content, or your violation of these Terms.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes not subject to arbitration shall be brought in the state or federal courts of Delaware.

17. Miscellaneous

  • Force Majeure: We are not liable for delays caused by events beyond our control
  • No Waiver: Our failure to enforce any right does not constitute a waiver
  • Severability: If any provision is unenforceable, the remainder remains in effect
  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement
